Supreme Court rules that the CCC Foundation's lawsuit against Apple is inadmissible
On 14 March 2025, the Dutch Supreme Court issued a ruling in the lawsuit that the Consumer Competition Claims Foundation (CCC Foundation) had filed against Apple. The Supreme Court declared the CCC Foundation's lawsuit inadmissible. This brings an end to the CCC Foundation's lawsuit against Apple.
The proceedings at the Supreme Court followed a ruling by the Amsterdam District Court on 16 August 2023. The court ruled that the CCC Foundation is
inadmissible because the summons to the CCC Foundation was not issued in time. The CCC Foundation disagrees with this ruling and filed
an appeal with the Supreme Court.
Unfortunately, the Supreme Court upheld the Amsterdam District Court's decision. This brings the proceedings of the CCC Foundation against Apple to an end. However, this does not end our commitment to fair treatment of consumers by Apple. After all, the problem has not yet been solved.
What does this mean for the participants?A large number of consumers have registered with the CCC Foundation for the proceedings against Apple. The CCC Foundation will continue to do its utmost to represent the interests of its participants as well as possible. The CCC Foundation is analyzing the consequences of the Supreme Court's decision and will soon be sending further information directly to consumers who have registered.
